
78TH EMMY® AWARDS INTERVlEW/CLlP RELEASE (Domestic and International Outlets)

Subject to all terms of this release (“Release”), the Academy of Television Arts & Sciences (“Television Academy”) grants you the non-exclusive permissions set forth below in connection with the 78th Emmy Awards (“Program”), which is currently scheduled to be exhibited on NBC (“Network”) on Monday, September 14, 2026. You agree as follows:
1 Interviews:
(a) You may record interviews (“Interviews”) conducted by you of Emmy Awards nominees, presenters, attendees and the like on the Program’s red carpet and in the NBC telecast Media Center (in-person and virtual) including, without limitation, “b-roll”/general footage of those venues (“Ancillary Footage”).
(b) During and for a reasonable time after the Program’s conclusion, you may also record Interviews conducted by you of winners and other attendees in the Media Center and b-roll shot at the Governors Gala afterparty.
(c) The Interviews and the Ancillary Footage (collectively, “Recorded Footage”) may only be exhibited, displayed, or otherwise used as part of your news program covering the Program, as follows: (i) no more than ten (10) minutes per hour of the Recorded Footage may be transmitted on a live basis by broadcast or live Internet streaming on any digital/social platforms prior to or during the Program; (ii) the Recorded Footage may be used without the time restrictions set forth in clause (i) after the initial U.S. live coast-to-coast Network broadcast of the Program; and (iii) In the case of international use, the Recorded Footage may be used without time restrictions in clause (i) after the first live broadcast of the Program in the territory in which you broadcast.
2. “Clips” from the Program
(a) You may use excerpts from the Program (“Clips”) only in the segment of your news program (i.e., broadcast, syndicated and/or streaming) covering the Program, and for no other purpose whatsoever. The aggregate length of all Clips used will not exceed four (4) minutes, with no individual Clip exceeding 30 seconds in length. The Clips from the Program are available for use from the conclusion of the initial Network broadcast for fourteen (14) days, including, if later, the weekend following such period for weekend-type news programs.
(b) In the case of news reports in foreign countries (i.e., outside of the United States, its territories and possessions), subject to any clearance required from the broadcaster in the territory in which you broadcast (if not you), the Clips may be used during a reasonable period — up to fourteen (14) days, or such longer time as may be approved in writing by or under authority of the chief operating officer of the Television Academy — following the first broadcast (including Internet transmission) of the Program in the territory in which you broadcast, if later than the initial Network broadcast in the United States.
(c) Except for transmission of the Clips for broadcast news purposes as specifically provided herein, you are not permitted to broadcast, “stream” or otherwise exploit any Clips without a written agreement with the Television Academy to do so. For any uses after the dates specified above, written permission must be obtained from the Television Academy, which may be granted or withheld at the Television Academy’s sole discretion.
B As between the Network, Television Academy and you, Television Academy is the sole owner of all copyrights and exclusive rights in and to the Clips, Interviews, and Ancillary Footage (collectively, the “Licensed Content”) and you shall give the Network (only in the case of U.S. exploitation) and Television Academy a courtesy credit for its grant of permission to use the Licensed Content in the form of: (a) for exploitation in the U.S., “Courtesy of the Television Academy and NBC” and (b) for exploitation outside the U.S., “Courtesy of the Television Academy.” For exploitation in the U.S., the Network’s logo(s) shall not be obscured and must be used as provided.
C. You shall obtain all required music and legal clearances, including without limitation payments to third parties, music costs and any residuals or reuse fees due and/or payable pursuant to any and all personal services contracts and/or collective bargaining agreements necessary for your use of the Licensed Content from any and all performers and persons who are featured or otherwise rendered services in connection with the Licensed Content, from all persons who appear recognizably in the Licensed Content, as well as consents from all unions and guilds to the extent any of their respective members performed in or in connection with the Licensed Content. If music is in the Licensed Content, or ambient music is heard in the Licensed Content, you will also obtain music synchronization and master use licenses from the owners of the music recordings and publishing, if required.
D. You acknowledge that the Television Academy and the Network have made no warranty or representation whatsoever, express or implied, with respect to the Licensed Content or your use thereof, except that Television Academy represents that it has the right under copyright to permit use of the Licensed Content subject to all conditions of this Release (including third-party clearances as provided in Paragraph C. above).
E. You shall defend, indemnify and hold harmless the Television Academy, the Network, their respective parent, subsidiary and affiliated companies, their owned and affiliated stations, and each of their respective officers, directors, agents, representatives, employees, successors and assigns, from and against any and all losses, actions, claims, demands, liabilities, damages or costs (including reasonable attorneys’ fees) of any kind or nature whatsoever which may arise out of or result from your unauthorized use of any of the Licensed Content or any other footage related to the Program, or your breach of this Release.
F. The rights, permissions, and authorizations granted under this Release are specifically for the benefit of your broadcast, syndicated and/or streaming news program only and shall not be assigned or transferred without written permission from the Television Academy.
G. Violation of any of the provisions above will be grounds for immediate revocation of the rights and licenses granted in this Release. You acknowledge that your presence at the Program and/or Pre-show or Post-Show indicates your agreement with all the foregoing.
H. This Release shall be governed by the laws of the State of California without regard to its conflict of laws principles, and any dispute arising under or in connection herewith shall be adjudicated exclusively in the state or federal courts sitting in Los Angeles, California. You consent to the jurisdiction of those courts and waive any objection based on the convenience of the venue.
